Terms of use
Last updated: 5 November 2026
This is a translation of the Hebrew version, which governs if the two differ.
These terms cover your use of Nikuvit: the website, the dashboard, the staff app and the API (together, “the service”). The service is for businesses. By signing up for or using the service, you agree to these terms and to the privacy policy. If you sign up on behalf of a business, you confirm that you are authorized to bind it.
The terms of each loyalty card toward the business’s own customers are the business’s, and are not part of these terms.
Your account
- Keep your account and business details accurate and up to date.
- You are responsible for keeping your password safe, and for everything done in your account and in the staff accounts you create.
- New businesses go live after we approve them. We may decline to open an account.
- If you learn of unauthorized use of your account, tell us right away.
Trial, packages and payment
- A new account starts with a free 14-day trial. After it ends, you can choose a paid package.
- Prices are listed on the website, in shekels, before VAT. Payment is monthly, or yearly in advance on packages that offer it.
- Payment renews automatically at the start of each period, charged to the card you saved, until you cancel. You’ll get a receipt for every payment.
- Switching packages takes effect at once, and the unused part of the previous package is taken off the price.
- You can turn off renewal at any time in the dashboard. Your package keeps working until the end of the paid period. The unused part is not refunded, unless the law requires otherwise.
- If your package has ended or a payment failed, the cards your customers already have keep working: you can still add stamps and redeem rewards. New customer sign-ups, messages and automations pause until you renew.
- A price change applies to an existing package only from the period starting at least 30 days after we announce it.
Your data and your customers
- The content you upload (logo, designs, texts) and the data about your customers belong to you. You allow us to use them only to provide the service to you.
- You are responsible for your customers’ data, and we hold and process it on your behalf, on your instructions and as described in the privacy policy. We’ll keep it confidential and secure, and won’t use it for anything else.
- Collecting and using that data lawfully is your responsibility. That includes showing your customers a privacy policy and terms (the service offers a default text, which is not legal advice), handling requests to see, correct and delete data, and meeting any obligation the Privacy Protection Law places on you.
- Advertising messages may be sent only to customers who agreed to receive them, under section 30A of the Communications Law. The service sends messages only to customers who ticked the consent box, but you are responsible for what your messages say.
- Before your account is closed, we’ll send you a copy of your customer list on request.
Prohibited use
You may not use the service to:
- break the law, or infringe the rights of others, including copyright and trademarks (for example, uploading a logo that isn’t yours);
- impersonate another business or mislead customers;
- send spam, or offensive, misleading or unlawful content;
- get around the security measures or the package limits, overload the service, or access other businesses’ data;
- copy, resell or reverse-engineer the service.
We may remove content that breaks these terms.
Apple, Google and other providers
The cards are stored in Apple’s and Google’s wallets and are subject to their rules. They may change or limit their services and remove cards, which we don’t control. The same goes for other providers the service relies on, such as the payment processor.
Availability and changes to the service
We work to keep the service available and working properly, but we don’t promise it will run without interruptions or errors, and there may be breaks for maintenance. We may change, add or remove features. If we remove a material feature from a paid package, we’ll tell you in advance.
Liability
- The service is provided “as is”. To the extent the law allows, we are not liable for indirect or consequential damage, such as lost revenue, profits, customers or data.
- To the extent the law allows, our total liability to you is limited to what you paid us in the 12 months before the event.
- You will indemnify us for any claim or expense caused by your content, the messages you sent, your use of your customers’ data, or a breach of these terms.
Suspension and closing an account
- You can stop using the service and ask us to close your account at any time.
- We may suspend or close an account that breaches these terms, doesn’t pay, or puts the service or other users at risk. Unless the matter is urgent, we’ll give notice first.
- After an account is closed, we delete its data as described in the privacy policy.
Changes to these terms
We update these terms from time to time. We’ll announce material changes in the dashboard or by email at least 30 days before they take effect. Continuing to use the service after that date means you accept the updated terms.
Governing law and jurisdiction
These terms are governed by the laws of the State of Israel. The courts of Tel Aviv-Jaffa have exclusive jurisdiction.
